Why aren’t you punished for singing a few lines a cappella?

Many people don’t know that songs to be sung at concerts must be submitted for approval in advance.

The “Regulations on the Administration of Commercial Performances” clearly stipulates that the preparation of commercial performances requires the submission of relevant program materials. If the performance program is adjusted, the approval procedures must be re-completed.

When the audience buys a ticket to enter the venue, the content they see should be consistent with what was submitted for approval.

This process usually starts several months in advance, and the track list and accompaniment details for large-scale concerts must be submitted.

News related to Liu Huan’s death was announced on September 26. On the evening of the same day, Na Ying was holding her solo concert in Chengdu.

The interval between before and after is less than a whole day, and it is completely impossible to go through the entire approval process from scratch.

The penalty provisions in the regulations are aimed at changing the performance program.

A song only hums a few lines and does not constitute an independent formal program, so there is no prerequisite for change.

For temporary additional singing of the same nature, the processing results can be very different.

In June this year, Zhang Liangying’s commercial performance accounted for too much a cappella content, and the organizer of the event was fined.

She later stated on social platforms that there is a high probability that there will be no more a cappella-related sessions in various commercial performances in the future.

The lawyer’s explanation was that what was fined was not the a cappella singing itself, but the content of the unapproved improvisation.

Zhang Liangying’s situation happened at a commercial platter concert. Each artist only performed three or four fixed tracks, and the number of registrations was small. The a cappella tracks were not registered in advance, which was a violation of the line.

Guo Degang’s situation is more serious.

During the special performance of “Jigong Living Buddha” in Wuhan in July, he adjusted the lyrics of “Play My Beloved Tu Pipa”, replaced the place names in the original words, and added many witty and funny phrases.

The Wuhan Bureau of Culture and Tourism finally issued a penalty: the performance organizer confiscated more than 48,000 yuan of illegal income and fined more than 486,000 yuan. The performance venue was also fined 110,000 yuan, and all fines and confiscations totaled more than 640,000 yuan.

“Play My Beloved Pipa” is an episode of the movie “Railway Guerrillas” and was selected into the list of outstanding songs released by the Propaganda Department of the Central Committee of the Communist Party of China.

What Na Ying sang was “The Crooked Moon”, a song of mourning. The motive was to bid farewell to an old friend. The form was snippet humming, with no leading problem.

The combination of these conditions led to the result of no punishment.

I think when these three cases are taken together, the boundaries of the rules become clear.

The Hangzhou Station is located at the Hangzhou Olympic Sports Center Gymnasium on October 31, and the Wuhan Station is located at the Wuhan Optics Valley International Tennis Center on November 21.
